Terms of Service

These Terms of Service (“Terms”) govern your use of TunePoint (“the Service”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.

1. What the Service is

TunePoint provides automated, AI-based sentiment and emotion analysis of text you submit — single messages or bulk document uploads. Results (sentiment labels, polarity/subjectivity scores, emotion breakdowns) are generated by statistical and machine-learning models. They are estimates, not verified facts, and may be inaccurate, incomplete, or misleading for any given piece of text.

2. Not a basis for high-stakes decisions about people

The Service is intended for general business analytics (e.g. understanding review or feedback trends). It is not designed, validated, or intended to be used — alone or as the primary basis — for decisions about an individual person’s employment, credit or lending eligibility, insurance, housing, healthcare or medical treatment, legal rights, or law-enforcement or immigration matters. If you use the Service in or alongside any such decision, you are solely responsible for independent human review and for complying with any law that applies to automated decision-making in your jurisdiction (which may include a right to human review, an explanation, or an opt-out for the affected person).

3. Your account

You must provide accurate registration information and keep your credentials confidential. You’re responsible for activity that happens under your account. Tell us promptly if you suspect unauthorised access.

4. Acceptable use

You agree not to use the Service to:

  • submit content that is illegal, or that infringes someone else’s rights;
  • attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service or other users’ data;
  • exceed the rate limits or usage quotas of your plan through automated abuse; or
  • resell or provide the Service to third parties as your own product without our written agreement.

We may suspend or terminate accounts that violate this section, with or without notice depending on severity.

5. Your content

You retain ownership of the text you submit for analysis. You grant us a licence to process it solely to provide the Service to you (including, for certain engines, sending it to a third-party AI provider as described in our Privacy Policy). You’re responsible for having the right to submit any text you upload, including text authored by or about other people.

6. Plans and billing

Paid plans are billed in advance on a recurring basis via Stripe. You can cancel anytime; access continues until the end of the current billing period. We don’t control Stripe’s own terms for payment processing. Prices and included usage limits may change with notice for future billing periods.

7. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON’T WARRANT THAT ANALYSIS RESULTS ARE ACCURATE, COMPLETE, OR RELIABLE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY DECISION MADE IN RELIANCE ON THE SERVICE’S OUTPUT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. Nothing in these Terms limits liability that can’t lawfully be limited (for example, liability for fraud, or for death or personal injury caused by negligence, where applicable law says so).

9. Termination

You may stop using the Service and close your account at any time (contact us — see §12). We may suspend or terminate access for breach of these Terms, non-payment, or if required by law.

10. Changes to these Terms

We may update these Terms as the Service changes. Material changes will be reflected by an updated “Last updated” date; continued use after a change means you accept the update.

11. Governing law

These Terms are governed by the laws of Australia, without regard to conflict-of-law principles. This applies regardless of where you access the Service from — we serve customers worldwide, but disputes are resolved under Australian law.
